We may revise these terms of use at any time by amending this page. 

Please check this page from time to time to take notice of any changes we made, as they are binding on you. 

Changes to Our Site 

We may update our site from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. 

We do not guarantee that our site, or any content on it, will be free from errors or omissions. 

Accessing Our Site 

Our site is made available free of charge. 

We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period. 

You are responsible for making all arrangements necessary for you to have access to our site. 

You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them. 

MindSync Membership

Your MindSync membership starts on the date that you sign up and your payment via a valid payment method is accepted. By starting your membership, you authorise us to charge you a monthly fee at the subscription rate prevailing on the renewal date.

When you sign up and purchase your membership, your first payment will be billed immediately. Your subscription payment is on a rolling monthly basis and unless cancelled (by you), or terminated (by us), in accordance with these Terms, automatically renews each month, for monthly plans, or on the anniversary of the purchase date for annual plans. For example, if you purchase your membership on 1st January 2024, your subscription will automatically renew on 1st February 2024 for monthly plans, or 1st January 2025 for annual plans. You must provide us with a current, valid, accepted method of payment (as set out on our website) to use MindSync. We reserve the right to change the subscription fees from time to time.

The details of your membership are shown on your ‘My MindSync’ profile within the ‘Subscriptions’ section.

Your Account and Password 

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party. Accordingly, you are responsible for all activities that occur under your Account. 

You can delete your Account at any time, for any reason, by emailing admin@mindsync.co.uk. Upon termination of your rights under these Terms, your Account and right to access will terminate immediately. You understand that any termination of your Account may involve deletion of your User Content associated with your Account from our live databases. 

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use. 

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at admin@mindsync.co.uk

Ending Membership

You may terminate your MindSync membership at any time by giving to us at least three days prior notice ahead of a renewal date. For example, if your next renewal date is 1st February, you need to cancel by 28th January to avoid being charged for the next month.

Your membership will still be valid for the subscription time you have already paid for. We do not offer refunds or credits for additional access for any unused subscription periods, change of mind, accidental purchases, medical reasons or any other reason unless required to do so by law.

To cancel your subscription, you will need to access your ‘My MindSync’ profile and access the ‘Subscriptions’ section within. From here, you will have the option to cancel your membership. Alternatively, you can email admin@mindsync.co.uk to provide written notification of your intention to cancel.

No Reliance on Information

The content on our site is provided for entertainment purposes and general information only and is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
We operate in the health and wellbeing sector however, we are not a medical device provider. Therefore, the content on our site and related services should not be considered medical advice. We make no promises that the content we provide is of therapeutic benefit and any health information offered by us or by a third party provider, is purely for your convenience.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up-to-date.

Limitation of Our Liability

We shall not be liable for any errors in any content, actions taken, injuries or and misfortunes that may occur when you are using our content. Furthermore, we will not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Session Participation

By signing up to MindSync, you confirm that you wish to participate in the session/exercise class/activity. In doing so you accept that your participation in these activities involves potential risk of injury, including but not limited to bodily injury, heart attack, stroke, or even death. You also recognise there are other risks associated with exercise and that it is not possible to list all of these. You confirm that you know and understand the risks of exercise, understand that injuries are a possibility, and you hereby assume all risks of injury which could occur by reason of your participation in anything related with MindSync. You confirm that you are in good health and are able to take part in this activity. You agree to take full responsibility for your own health and well-being and agree that any instructions received will be used at your own risk.

If you have a medical concern or health-related question, please consult with your GP before participating. The instructions and advice presented are in no way intended to be substitute for medical counselling/advice. Not all exercises are suitable for everyone and this or any other exercise program may result in injury.

Any user of this exercise program assumes the risk of injury resulting from performing the exercises shown. The creators, producers, participants, instructors and distributors of this program disclaim any liability or loss in connection with the exercises and advice contained herein.

You are required for your own safety to disclose any relevant medical information, to update this as may be necessary and understand that you are participating at your own risk.

Live Streams

As a user of this site, you will not record live streamed classes or on demand videos in any way. Should recording be made, appropriate action will be taken to remove and/or delete said recording. Any such recording will be considered an infringement of the intellectual property rights of MindSync Ltd which reserves its full rights to take any and all necessary enforcement action.

All content including but not limited to the MindSync brand and logo and choreography are copyrighted materials and subject to copyright law regarding use and distribution without permission.

Disclaimer

You agree that attendance at or use of any such sessions, activities, or other services is solely at your own risk. In no event shall MindSync be liable for any injury, loss, claim, damage or any special, exemplary, punitive, incidental or consequential damages of any kind, whether based in contract, tort or otherwise, which arises out of or is any way connected with a user’s attendance or participation in a session, activity or service made through the site, or the performance or non-performance in connection with the services.

Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.

Those who choose to access the MindSync website (www.mindsync.co.uk) do so at their own initiative and are responsible for compliance with all applicable laws. As a condition of your use of the site, you will not use the site for any purpose that is unlawful or prohibited by these Terms.

You may not use the site in any manner that, in our sole discretion, could damage, disable, overburden, or impair it or interfere with any other party’s use and enjoyment of the site. You may not attempt to gain unauthorised access to the site, or any part of the site, other accounts, computer systems or networks connected to the site, or any part of them, through hacking, password mining, or any other means or interfere or attempt to interfere with the proper working of the site or any activities conducted on the site.

You may not remove, circumvent, disable, damage or otherwise interfere with security-related features of the site, any features that prevent or restrict use or copying of any content accessible through the site, or any features that enforce limitations on the use of the site or the content therein.

Applicable Law

If you are a consumer, please note that these terms of use, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
